Rental terms

These general terms summarise the framework of the car rental service provided by RentacarIQ. They are informative and pre-contractual: the definitive agreement between the parties is the rental contract signed when the vehicle is handed over.

1. Purpose and acceptance

These terms govern the service of renting motor vehicles without a driver provided by Funnel Solutions, S.L.U., and the information made available through https://rentacariq.com.

By requesting a quote through the website, the user declares that they have read and accepted these terms, as well as the Privacy policy and the Legal notice.

In the event of any conflict between these terms and the signed rental contract, the signed contract prevails.

2. A quote request does not reserve the vehicle

The website does not allow online booking or payment. The form only passes on to the RentacarIQ team your interest in a particular vehicle and specific dates.

Once we receive your request, we will contact you to confirm actual availability and provide a quote. Until then, the vehicle is not held in your name and may be rented to another customer.

3. Rental requirements

The rental is subject to minimum requirements regarding age, length of driving licence and documentation, set out in the frequently asked questions section at the end of this document.

RentacarIQ may refuse to hand over the vehicle if, at the time of collection, the customer cannot prove that those requirements are met or the documentation presented is not valid.

4. Price, taxes and payment

The prices published on the website are indicative, per rental day and include VAT, and refer to the vehicle’s base rate.

The final price depends on the dates, the duration, the pick-up and drop-off point, the contracted mileage and any extras requested. It is stated in the quote and set out in the contract.

Unless otherwise agreed, payment is made by bank card in the name of the main driver. Cards belonging to third parties outside the contract are not accepted.

Items that may be charged separately

  • Mileage exceeding the contracted limit, at the agreed per-kilometre rate.
  • Missing fuel compared with the level at handover, plus refuelling handling costs.
  • Extraordinary cleaning where the level of dirt exceeds normal use.
  • Late returns not authorised in advance.
  • Damage not covered by the insurance, up to the applicable excess.
  • Traffic fines and the costs of processing them.

5. Deposit

Every rental requires a refundable deposit as security for performance of the contract; the amount depends on the vehicle and is communicated before handover.

The deposit is refunded once it has been verified that the vehicle is returned in the same condition in which it was received, with no damage, no outstanding fines and no additional charges. This verification may take a reasonable period, particularly where fines may be notified at a later date.

6. Insurance and excess

All vehicles carry compulsory third-party liability insurance and the cover specific to each vehicle.

There may be excesses and exclusions. In particular, cover may cease to apply in cases such as driving by a person not authorised in the contract, driving under the influence of alcohol or drugs, use of the vehicle for purposes prohibited by these terms, or the wilful concealment of an incident.

In such cases, the renter will be liable for the damage caused.

7. Use of the vehicle

The vehicle must be used with care and in accordance with traffic regulations. The following are expressly prohibited:

  • Allowing persons not authorised in the contract to drive.
  • Subletting the vehicle or using it for the paid transport of people or goods, unless expressly authorised.
  • Using it in competitions, speed trials or driving courses.
  • Driving on unsuitable roads, tracks or terrain that may damage the vehicle.
  • Towing or pushing other vehicles.
  • Carrying dangerous, flammable or illegal goods, or more people than authorised in the vehicle’s technical specification.
  • Driving under the influence of alcohol, drugs or medication that impairs driving ability.
  • Leaving Spanish territory without prior written authorisation.

8. Fuel, mileage and maintenance

The vehicle is handed over and must be returned with the same fuel level, which is recorded in the contract.

Each rental includes a number of kilometres stated in the quote and in the contract. Any kilometres beyond that are charged at the agreed rate.

Routine maintenance and repairs arising from normal use are borne by RentacarIQ. The renter must check fluid levels periodically and report any fault immediately, and must not carry out repairs without authorisation.

9. Collection, return and delays

Collection and return take place at the agreed place, date and time. At handover a vehicle condition report is drawn up, which both parties review and sign.

Returning the vehicle outside the agreed time without prior authorisation may give rise to additional charges. If you expect to be late, contact us as soon as possible so we can consider an extension.

Failure to return the vehicle within the agreed period without justification may lead to a formal complaint being filed.

10. Accidents, breakdowns and assistance

In the event of an accident, the renter must notify RentacarIQ immediately on +34 621 065 627, complete the European accident statement, not admit liability on behalf of the owner, and call the authorities where there is personal injury, disagreement between the parties or an unidentified vehicle involved.

In the event of a mechanical breakdown not attributable to the driver, assistance will be arranged in accordance with the available cover.

11. Fines and penalties

The renter is responsible for offences committed during the rental period, as well as for toll, parking and towing charges.

As the registered keeper of the vehicle, RentacarIQ is legally obliged to identify the driver to the authorities when required to do so, and will provide them with the renter’s details for that purpose. It may pass on the amount of the penalty plus handling costs, which will be communicated in advance.

12. Cancellation and changes

Cancellation and amendment terms depend on how far in advance they are requested and on the vehicle, and are communicated together with the quote and in the contract.

A quote request that has not yet resulted in a contract may be cancelled at any time free of charge: simply let us know.

13. Right of withdrawal

Under article 103.l of Spanish Royal Legislative Decree 1/2007 (consolidated text of the General Law for the Defence of Consumers and Users), the right of withdrawal does not apply to vehicle rental contracts that provide for a specific date or period of performance.

This does not affect the cancellation terms agreed in each contract, which apply independently, nor the rights granted to consumers by law in the event of a breach.

14. Data protection

Personal data provided is processed in accordance with the Privacy policy, which forms an integral part of these terms.

15. Complaints, governing law and jurisdiction

Any complaint may be addressed to info@rentacariq.com or to +34 621 065 627. Official complaint forms are available to customers.

These terms are governed by Spanish law. Where the customer qualifies as a consumer, the courts of their domicile shall have jurisdiction, and they may turn to the competent consumer authorities and consumer arbitration boards.

Frequently asked questions about the rental

This section forms part of the terms and sets out the specific requirements of the rental.

What do I need in order to rent a car?

To rent a car with Rentacar IQ you must meet a number of basic requirements, so as to guarantee everyone's safety and the correct use of the vehicle:

  • Be at least 23 years old.
  • Hold a valid, current driving licence issued at least 2 years ago.
  • Present a valid national ID card, foreigner ID (NIE) or passport.
  • Hold a bank card in the name of the main driver, for payment and for the security deposit.
  • Be the authorised driver of the vehicle throughout the entire rental period.

Before handover we will check your documents and carry out a brief inspection of the vehicle together with you. We may also request additional information in order to validate the booking and ensure our rental terms are met.

By making a booking, the driver agrees to use the vehicle responsibly, complying with current traffic regulations and with the conditions set out in the rental agreement.

Is a security deposit required to rent a vehicle?

Yes. All our rentals require a refundable security deposit, held as a guarantee for the duration of the rental. The amount may vary depending on the vehicle booked, and it will be returned once the car has been checked and confirmed to be in the same condition in which it was handed over, with no damage, outstanding fines or additional charges.

Who is allowed to drive the vehicle?

Only those persons authorised and named in the rental agreement may drive the vehicle. Handing the vehicle over to unauthorised third parties is not permitted. In the event of an accident or incident caused by an unauthorised driver, insurance cover may be invalidated and the renter would be liable for any damage caused.

What documents must I bring on the day of collection?

To collect the vehicle you will need to present:

  • A current national ID card, foreigner ID (NIE) or passport.
  • A valid driving licence.
  • A bank card in the name of the main driver.
  • Your booking confirmation, where applicable.

Documents must be originals and valid at the time of handover.

Can I take the vehicle outside Spain?

No. Unless Rentacar IQ gives express written authorisation, vehicles may only be driven within Spanish territory. If you need to travel abroad, you must request prior authorisation before collecting the vehicle.

What happens if I return the car late?

The vehicle must be returned on the agreed date and time. Delays that are not notified may incur additional charges. If you expect not to be able to return the vehicle on time, we recommend contacting our team as soon as possible so we can look into extending the rental.

What happens in the event of an accident or breakdown?

In the event of an accident, you must contact Rentacar IQ immediately and follow the instructions given by our team and the insurer. If a mechanical breakdown occurs that is not attributable to the driver, the corresponding assistance will be arranged in line with the available cover.

Is there a mileage limit?

Yes. Each rental includes a set number of kilometres, which will be clearly stated during the booking process and in the rental agreement. If the contracted limit is exceeded, the additional per-kilometre rate stated in the booking conditions will apply.

Is insurance included?

Yes. All vehicles carry compulsory insurance and the corresponding cover for each vehicle. However, excesses or exclusions may apply in certain circumstances. We recommend reviewing the specific conditions for the vehicle before confirming your booking.

Can I cancel or change my booking?

Yes. Cancellation and amendment conditions depend on how far in advance the request is made and on the vehicle booked. For any change, contact our team as soon as possible so we can offer you the best available solution.
